About these terms
These Terms of Use govern your access to and use of the BreakAway mobile application and related services. By creating an account or using BreakAway, you confirm that you have read, understood, and agree to these terms. If you do not agree, please do not use BreakAway. These terms are available at any time at https://gobreakaway.app/terms.
Eligibility
You must be at least 18 years old to use BreakAway. By signing up, you confirm you are 18 or older and have the legal capacity to enter into a binding agreement. We reserve the right to remove accounts that do not meet this requirement, without prior notice.
Access and your personal key
BreakAway opens region by region as we launch. Within an active launch region, you can create an account and start using BreakAway right away. You can also be brought in through an existing member's personal key or a plan invite, which connects you to the people who invited you. Keys and invite codes are personal: you may not share, sell, or transfer them for compensation. We reserve the right to restrict, revoke, or remove access — including for misuse of keys or codes, or any violation of these terms.
Your account
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Your account is personal and non-transferable. You may not create accounts on behalf of others or operate multiple accounts. Provide accurate, current information when signing up. Impersonating another person or using a false identity is not permitted and will result in immediate removal.
How you may use BreakAway
BreakAway is for genuine real-life connection. You may use it to: • Create and join plans and groups • Connect with people nearby • Chat within plans and groups • Bring friends in using your personal key You may not use BreakAway to: • Promote businesses or commercial services • Recruit for organisations or solicit money • Send unsolicited messages or spam • Scrape, copy, or reverse-engineer any part of the app • Engage in any commercial activity without our prior written consent
Community standards
BreakAway is built on mutual respect. The following are strictly not tolerated: • Harassment, abuse, intimidation, or threatening behaviour • Hate speech targeting gender, religion, caste, ethnicity, nationality, disability, or sexual orientation • Sharing explicit, violent, or non-consensual content • Any content that sexualises minors, or child sexual abuse material (CSAE/CSAM) — zero tolerance; see our Child Safety Standards at https://gobreakaway.app/child-safety • Deceiving others about your identity or intentions • Attending plans with intent to cause harm Violations may result in immediate removal without notice, and may be reported to relevant authorities where required by law.
Women-only spaces
BreakAway supports women-only plans and groups. These spaces are restricted to users who identify as women. Misrepresenting your gender to access these spaces is a serious violation and will result in permanent removal from the platform.
Plans and meet-ups
BreakAway is a platform that facilitates connections between people. We are not responsible for what happens at plans or meet-ups arranged through the app. By using BreakAway, you acknowledge that meeting other users in person carries real-world risk and you do so entirely at your own discretion. If you create a plan, you are responsible for the accuracy of the details you provide. If you join one, you are responsible for attending or cancelling in reasonable time. You agree to take reasonable precautions when meeting other users, including meeting in public places and informing someone you trust.
No background checks
BreakAway does not conduct background checks, identity verification, or criminal record checks on any user. We make no representations about the character, intentions, or conduct of any person you meet through the app. You are solely responsible for your own safety when interacting with other users, both online and in person. Exercise the same caution you would in any real-world social situation. If something feels wrong, trust your instincts.
Assumption of risk
By using BreakAway to meet other people, you voluntarily assume all risks associated with those interactions. To the fullest extent permitted by applicable law, BreakAway is not liable for any harm, loss, injury, or damage — physical, emotional, financial, or otherwise — that may arise from plans or meet-ups arranged through the platform. This app is a tool for connection. What you do with that connection is your responsibility.
Content you post
You retain ownership of the content you post on BreakAway (photos, messages, plan details). By posting, you grant us a limited, non-exclusive, royalty-free licence to store, display, and distribute that content within the app solely for the purpose of operating the service. We do not claim ownership of your content. We may remove content that violates these terms without notice, and without liability to you.
Account deletion
You may delete your account at any time via Settings → Danger Zone → Delete account, or by emailing gobreakaway.app@gmail.com. Upon deletion, your profile, messages, and associated data will be removed within 30 days. Some data may be retained where required by law or for safety purposes.
Reporting and moderation
Use the in-app report feature for any content or behaviour that feels unsafe or inappropriate. We review all reports and aim to respond within 48 hours. We reserve the right to remove any user or content at our discretion, with or without notice, if we believe it harms the community or violates these terms.
Availability
We do our best to keep BreakAway running smoothly, but we do not guarantee uninterrupted or error-free access. We may update, restrict, or discontinue parts of the app at any time without notice. We are not liable for any loss resulting from downtime, bugs, or changes to the service.
Limitation of liability
BreakAway is provided on an "as is" and "as available" basis. To the maximum extent permitted by the laws of India, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the app — including any harm arising from plans or meet-ups arranged through BreakAway. In no event shall our total liability to you exceed the amount you paid (if any) to use BreakAway in the 12 months preceding the claim.
Governing law and disputes
These terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 and applicable rules. Any dispute arising from these terms or your use of BreakAway shall first be attempted to be resolved by contacting us at gobreakaway.app@gmail.com. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in India.
Changes to these terms
We may update these terms as the app evolves. We will notify you of significant changes in-app and update the effective date above. Continued use of BreakAway after changes are posted means you accept the updated terms.
